Dear Prof Koppelman, maybe no one’s heard of the “symbolic” distinction between action and inaction because it has historically been taken for granted… if it isn’t challenged, no real reason to raise it, or coin a funky legal term for it to be used in uni courses.
I’m getting the impression that Koppelman cares alot more about progressive policies than law. The Shakespeare analogy is just mind-boggling. Such sloppiness in approaching the subject reflects poorly on his intentions.
